PROBATE is the legal process of settling and resolving an estate of a deceased person by resolving all claims against his or her property, paying debts and distributing the remaining property to the deceased’s heirs.

WILLS
A will is a document that addresses what happens to an individual’s assets upon their death. If you do not have a will, Tennessee law determines how your estate will be distributed, regardless of your wishes. A carefully prepared will allows you to distribute your assets, such as your house, car and savings to whomever you choose. Your can also specify who you would like to care for your children in the event of your death.
CONSERVATORSHIP/GUARDIANSHIP
A conservatorship or guardianship is for someone who is incapable of managing their financial affairs. The probate court appoints a conservator to manage the person’s affairs.
POWER OF ATTORNEY
A Power of Attorney for health care or financial assistance allows you to choose someone to make health care decisions or provide financial assistance for you.
ROLE OF EXECUTOR
An Executor is the person named by the decedent in the will to carry out the provisions of the will. The Executor hires counsel for guidance through the legal process of probating the decedent’s will. This includes determining the validity of the will, payment of creditors, distribution of estate assets and any specific procedures required by state law. Efficient and cost-effective legal representation allows the probate process to move as quickly as possible. WILL CONTEST
A will contest is a legal action that challenges the validity of a will. A will may be found invalid by the court if one can prove forgery, undue influence, lack of mental capacity or on other grounds.
