Bankruptcy is for debt relief to give debtors a fresh start from the burdens brought on by harassment from creditors. Bankruptcy will stop foreclosure, repossession, garnishments, lawsuits, phone calls and letters from creditors.

Chapter 7 gives debtors a fresh start. The primary purpose is to discharge (to not be legally obligated to pay) most debts. Chapter 7 can eliminate credit card debt, medical bills, payday loans, judgments, deficiency debts, or repossessed motor vehicles. Chapter 7 does not eliminate child support, some taxes and most student loans.

Chapter 13 is a debt consolidation repayment plan. Chapter 13 makes paying debt more manageable. Chapter 13 can stop foreclosures in most cases and allow repayment in order for debtors to keep their homes.. Plans generally last from 3 years to a maximum of 5 years.
